Boilerplate Creants

I have no idea what a Creant is, other than it is the opposite of a miscreant. There is a very specific reason professionals use “boilerplate documents” (BPDs), not the least of which is that the incorporated provisions of the BPD have survived challenges in the courts. This is why, for example, the Real Estate Commission of most states approves for use in real estate transactions Commission approved forms. The forms eliminate uncertainty, provide a standard against which to review all similar transactions and facilitate the speed at which transactions can be completed.

Nonetheless, the Miscreant raises its head when a licensed professional uses the BPDs for his or her own agenda, i.e. don’t blame the form; blame the user. I agree with Theresa (see boilerplate miscreants) that as leader of your business/team/investment you need to be on top of the transaction so the Creant doesn’t become a Miscreant.
